Jakarta, (Antara) - The Corruption Eradication Commission (KPK) said it will study the Supreme Court (MA) decision rejecting its attempt to review a pre-trial decision on corruption case of Hadi Purnomo favoring the former taxation director general and chairman of the Supreme Audit Board (BPK).
"It was true that KPK sought an extraordinary legal action of case review (PK) of the pretrial decision ruling a halt to further investigation of the corruption case with suspect Hadi Purnomo, former taxation director general. We will thoroughly study the decision (of the Supreme Court) before resuming legal action," KPK spokesman Febri Diansyah said here on Thursday.
An assembly of the Supreme Court chaired by Salman Luthan with members including Sri Wahyuni and MS Lumme on June 16, 2016 rejected the PK attempt against the pretrial decision of the South Jakarta district court which ruled as not valid KPK naming Hadi Poernomo a suspect.
The MA, however, added that the Jakarta district court has no authority to stop KPK from carrying on with investigation of the case.
The MA said the pretrial decision by the South Jakarta district court No 36/Pid.Prap/2015/PN.Jkt.Sel in verdict points 2, 4, and 5 were not correct.
On May 26 in 2015 judge Haswadi, who is chairman of the South Jakarta district court said the investigations by KPK which named Hadi a suspect were not valid and ruled a halt to the investigation.
One of the reasons cited by the district court for ordering a halt to investigations by KPK was that the anti graft agency had not enough evidence at least two valid proofs to name Hadi a suspect.
The district court ruling, however, could not stop KPK to carry on with the investigations and name Hadi a suspect again if KPK could produce at least two valid proofs.
The South Jakarta district court has no authority to stop further investigations of the case involving Hadi Poernomo, the copy of the MA decision said.
"KPK, therefore, would study the MA decision and see what could be done on the case we already handled earlier," Febri said.
KPK had charged Hadi Poernomo with abusing his authority when he was taxation director general in 2002-2004 over tax on non performing loans of Bank Central Asia in 1999-2003 worth Rp5.7 trillion.(*)
