Jakarta (Antara) - Manpower and Transmigration affairs minister Muhaimin Iskandar has reminded all companies to immediately pay "Lebaran" (Idul Fitri) allowance or THR to all workers including outsourcing and contract basis workers. "There is no difference regarding their work status with ergard to THR. All outsourcing and on contract basis workers who have been working for three months or more deserve receiving the THR," the minister said here on Monday. According to him, giving Lebaran allowance (THR) to all workers including outsourcing and contract basis ones has become a tradition to meet the needs of workers and their families for celebrating the religious holiday in compliance with the Manpower Minister's regulation number 04/MEN/1994 regarding religious holiday allowances for workers in companies. "Companies are obliged to pay the THR to workers/laborers. Therefore, the outsourcing workers and even those on contract basis deserve getting the THR in compliance with the regulation," Muhaimin said. The companies should pay the THR for the workers/labors once a year in line with the respective religious holiday, not later than a week before the religious holidays concerned. Even workers/labors who are exposed to Termination of Employment in a time limit of 30 days prior to the Religious holiday, still deserve to get the THR based on Article 6, paragraph (1) of the Minister of Manpower regulation number PER-04/MEN/1994 1994. The minister said anyone who finds indication of THR regulation violation, he or she should immediately report the case to the THR paying command posts at the regional offices of Manpower and Transmigration affairs ministry or to the central THR command post of the Manpower and Transmigration ministry in Gatot Subroto street Kav.51, South Jakarta, 8A floor. "I reiterate that I will take stern measure against companies that do not pay THR. The actions ranging from approach, advise, reprimand, mediation to a lawsuit to the court," the minister said. The Manpower and Transmigration Ministry will summon the company officials who are charged with the violation and will be brought to mediation meeting with the workers, he said. In accordance with the THR regulation, workers or labors who have been working for 12 months or more continuously, deserve receiving an amount of THR calculated based on the number of months of employment divided by 12 months multiplied by one month wage.
